Terms of Service

These Terms of Service ("Terms") govern your use of global-usa.com and any pages, content, forms, and newsletters we provide through it (together, the "Site"). The Site is operated by Global Computer Systems ("GCS," "we," "us," or "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. What these Terms cover

These Terms apply to the Site only. If your organization is a GCS client, the managed IT, cybersecurity, consulting, and other services we provide are governed by your written agreement with us (such as a master services agreement and statement of work). If these Terms conflict with that agreement, the agreement controls.

2. Information on the Site is not professional advice

Articles, checklists, and other content on the Site are general information about technology, security, and compliance topics. They are not legal, regulatory, insurance, or other professional advice, and they are not a substitute for an assessment of your specific environment. Laws and best practices change, and content may not reflect the latest developments. Using the Site or submitting a form does not create a client, contractual, or professional relationship with GCS. That happens only through a signed agreement.

3. Forms and communications

  • When you submit a form, you agree that the information you provide is accurate and that you are authorized to provide it on behalf of your organization.
  • Do not submit passwords, patient or health information, payment card data, Social Security numbers, or other sensitive information through the Site.
  • Submitting a request (for example, for a free IT assessment) does not obligate either of us. Any assessment or service is subject to scheduling and, where applicable, a separate written agreement.
  • If you subscribe to our newsletter, you agree to receive emails from us and can unsubscribe at any time. See our Privacy Policy for how we handle your information.

4. Acceptable use

You agree not to:

  • Use the Site in any way that violates applicable law or the rights of others
  • Scan, probe, or test the vulnerability of the Site or its infrastructure, or attempt to bypass its security or bot protection, without our prior written authorization
  • Interfere with or disrupt the Site, including by overloading it, sending automated form submissions, or introducing malware
  • Scrape, harvest, or collect content or information from the Site by automated means, except for search-engine indexing that follows our robots.txt
  • Impersonate GCS, our staff, or anyone else, or misrepresent your affiliation with any person or organization
  • Use the Site to send spam or unsolicited commercial messages

Security researchers: if you believe you've found a vulnerability in the Site, please report it using the contact in our security.txt file rather than testing further. We appreciate good-faith reports.

5. Intellectual property

The Site and its content, including text, graphics, illustrations, logos, and design, are owned by GCS or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own internal, non-commercial business use and share links to them. You may not otherwise copy, modify, republish, or distribute Site content without our written permission.

Third-party names, logos, and trademarks shown on the Site belong to their respective owners. Their appearance does not imply that those companies endorse GCS, except as expressly stated.

6. Feedback

If you send us suggestions or ideas about the Site or our services, you agree we may use them without obligation to you.

7. Third-party links and services

The Site may link to or use third-party websites and services (for example, vendor sites or our remote-support tool). We don't control them and aren't responsible for their content, security, or practices. Your use of them is governed by their own terms.

8. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, GCS disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.

9. Limitation of liability

To the fullest extent permitted by law, GCS and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of (or inability to use) the Site or its content, even if we've been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site will not exceed $100. Some jurisdictions don't allow certain limitations, so some of these may not apply to you. This section does not limit liability under a written client agreement, which is governed by its own terms.

10. Indemnification

You agree to indemnify and hold harmless GCS from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

11. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to their jurisdiction.

12. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms. When we do, we'll post the new version here and change the "Last updated" date. Continuing to use the Site after an update means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and GCS about the Site.
